DA Eric Toney Cracks Down on Fentanyl Deaths: We Will ‘Aggressively Prosecute’

When police tried to interview the defendant, he allegedly told them, “They can go f*** themselves.”

Fond du Lac County District Attorney Eric J. Toney announced that Omar J. Simpson was sentenced to 22 years of imprisonment, consecutive to any other sentence, by Judge Laura Lavey. Simpson was accused of dealing fentanyl that contributed to the death of a mother who worked at Kohl’s.

The criminal complaint describes the tragic scene:

“On March 5, 2022 at 1214 hours Officer Sprangers was dispatched to Muenter Av. for a female that had
overdosed and was not breathing. The caller believed that the subject was deceased. Upon arrival Officer Sprangers was met inside by the paramedics who advised that the female was beyond life saving measures. I was directed to the back bedroom of the residence where I saw what appeared to be a white female that was hunched over on the side of the bed. She was not breathing and I could see that the side of her face had started to change color, she was stiff and cold to the touch. Once Officer Tuttle arrived, I asked that he remain in the bedroom.”

DA Eric Toney Obtains a Conviction

“The sentence is broken down as follows, 12 years of initial confinement and 10 years of extended supervision. Simpson was convicted of 2nd Degree Reckless Homicide – Repeater for his role in the delivery of fentanyl that contributed to the death of a mother on March 5, 2022, in the City of Fond du Lac.

District Attorney Toney stated, “The illicit flow of fentanyl into the United States and into Wisconsin destroys families, with parents continuing to bury their children and other children growing up without their moms and dads. We will continue to stand with all those families to aggressively prosecute those responsible for selling fentanyl in our communities. I hope this sentence serves as a deterrent and motivation to help others seek treatment in a way that saves lives.”

This case was investigated by the City of Fond du Lac Police Department and prosecuted by District Attorney Eric Toney.

Toney is running for state Attorney General against incumbent Democrat Josh Kaul, whose office was previously criticized by a top tribal leader for leaving the northern part of the state without DOJ narcotics investigators.
