Wisconsin DA Eric Toney Charges Illegal Immigrant With Brutally Stabbing Woman 26 Times

“Illegal immigration continues to present serious challenges for law enforcement and communities across Wisconsin, with Fond du Lac County recently prosecuting other illegal migrants for Human Trafficking, Sexual Assault, and Attempted Homicide” – Eric Toney.

Fond du Lac County District Attorney Eric J. Toney has charged an illegal immigrant named Luis Antonio Sevilla Benavidez in the brutal stabbing of a woman, who was injured so badly that she had holes in her intestines.

According to the criminal complaint, Benavidez grew enraged when he was told to turn down music. He then attacked his mother, pushing her to the ground and ultimately stabbing her 26 times, according to the complaint. He was drinking alcohol, it alleges.

“The Defendant was making statements that if anyone called the police he was going to kill them and the police as well,” the complaint says. The victim had “at least 26 stab wounds on Victim 1 that he (the paramedic) could see during his assessment in the ambulance. This included 12 wounds to the abdomen, 5 to the breasts, 6 to the right arm, and 2 the left leg,” the complaint adds.

Victim 1 “stated that it started when she told the Defendant to turn down the music. Victim 1 stated that the Defendant was drinking some sort of alcoholic beverage,” the complaint adds. “At one point the Defendant threatened to kill her and approximately an hour later Victim 1 was in her room. The Defendant hit her a lot on the left side of her head with hands and threw her to the ground. Victim 1 stated that approximately an hour later the Defendant knocked down her bedroom door while
she was locked inside and began stabbing her. Victim 1 stated she believes if the Defendant gets out of jail he will kill her.”

Benavidez “made his initial court appearance on charges of Attempted First Degree Intentional Homicide, Mayhem, and Aggravated Battery,” Toney wrote in a press release. “All three charges include Domestic Abuse and Dangerous Weapon enhancers. Judge Tricia Walker set cash bond at $2 million and the defendant is anticipated to be court again on April 17 at 1:30 for preliminary hearing status conference.”

The charges “stem from a brutal stabbing that occurred on March 21, 2026 in the City of Fond du Lac. The defendant is believed to be from Nicaragua and the Department of Homeland Security advised that the defendant has no legal status and is illegally in the United States. The defendant is presumed innocent unless or until proven guilty,” according to Toney’s release.

Toney, a Republican, is running for Wisconsin Attorney General.

“The rapid response of the Fond du Lac Police Department and Officer Stelter may have saved the woman’s life by stopping a crime in progress. Illegal immigration continues to present serious challenges for law enforcement and communities across Wisconsin, with Fond du Lac County recently prosecuting other illegal migrants for Human Trafficking, Sexual Assault, and Attempted Homicide,” Toney said.

This case is being investigated by the City of Fond du Lac Police Department and prosecuted by District Attorney Eric Toney.
